  1. ACCEPTANCE OF TERMS

These Terms and Conditions ("Terms") govern the use of Wer's services, including but not limited to its website, mobile application, and any other online platforms operated by Wer (collectively referred to as "Wer" or the "Services"). By accessing or using Wer's Services, you agree to be bound by these Terms.

Wer retains all rights in and to its Intellectual Property, including but not limited to trademarks, logos, copyrights, trade secrets, patents, and know-how. Users do not acquire any ownership or proprietary interests in Wer's Intellectual Property through use of the Services.

  1. PROHIBITED CONDUCT

Users agree not to:

  • Use the Services for any unlawful purpose;
  • Engage in conduct that is defamatory, obscene, pornographic, harassing, or abusive towards others;
  • Upload, post, email, or otherwise transmit Content that contains viruses, Trojan horses, worms, time bombs, corrupted files, or other code designed to interfere with or damage the operation of Wer's Services;
  • Use automated tools, scripts, bots, spyware, adware, malware, trojans, or any other malicious software;
  • Copy, reproduce, republish, upload, post, email, display, perform, distribute, transmit, or otherwise exploit Content without permission from Wer;
  1. USER CONTENT

Users retain ownership of the Intellectual Property in Content that they create and submit to Wer's Services ("User Generated Content"). By submitting User Generated Content, Users grant Wer a non-exclusive license to use, reproduce, modify, display, perform, distribute, transmit, or otherwise exploit such Content for the purpose of providing its Services.

Wer reserves the right to review, edit, remove, or reject any User Generated Content at any time without prior notice.

  1. LIABILITY

Toto 5D WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSSES RESULTING FROM RELIANCE ON CONTENT CONTAINED IN Toto 5D'S SERVICES; DELAYS; INTERRUPTIONS; DATA LOSS; COMPUTER VIRUSES; SYSTEM FAILURES; NETWORK PROBLEMS; ERROR CORRECTION; SOFTWARE MALFUNCTION; AND HARM CAUSED BY THIRD PARTY USE OF THE SERVICES.

Toto 5D WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM USE, RELIANCE ON, OR INTERACTION WITH ADVERTISERS' CONTENT AND PRODUCTS PRESENTED THROUGH Toto 5D'S SERVICES.

  1. CONFIDENTIALITY

Wer reserves the right to store and use any data provided by Users for operational, security, or marketing purposes in compliance with applicable laws and regulations.

  1. DATA PROTECTION

Users agree that they shall not take any actions intended to compromise Wer's Services' infrastructure, disrupt normal functioning of its systems, interfere with other users' enjoyment of the Services, damage reputation of Wer, or use information available through the Service for an unlawful purpose.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and all disputes arising in connection herewith will be governed by and construed in accordance with applicable laws. All claims must be brought within one year from the date such claim arises.

Toto 5D WILL HAVE THE RIGHT TO RESOLVING ANY CLAIM OR ACTION ARISING FROM THESE TERMS IN A COURT SITUATED WITH JURISDICTION OVER THE PLACE WHERE Toto 5D HAS ITS PRIMARY PLACE OF BUSINESS, WITHOUT REGARDS TO CHOICE OF LAW.

  1. ENTIRE AGREEMENT

These Terms constitute the entire agreement between Users and Wer with regard to its Services and supersedes any prior or contemporaneous agreements between them relating thereto.

Wer may update these Terms at any time without prior notice, so users must regularly check this webpage for updates.

  1. WAIVER OF BREACHES

The failure of Wer to enforce a provision set forth in these Terms shall not be deemed a waiver of that or any other right under the Terms and does not preclude either party from pursuing rights or remedies available at law or in equity.

  1. SEVERABILITY

If any term, condition, covenant, restriction, representation, warranty, or promise contained herein is held by a court to be invalid, void, or unenforceable for any reason whatsoever, the remaining provisions hereof will continue in full force and effect as if such provision had never existed.

  1. LIMITATION ON ACTIONS

Unless prohibited by law, Users agree that no action, regardless of form, arising out of these Terms may be brought more than one (1) year after the cause of action arose.
